Your purchase includes a professionally designed residential home plan developed by B Ingenious Designs.

Building a home involves several important phases. We recommend following these steps to help move your project forward.
Step 1: Review Your Plans
Take time to review every page of your plans with your family and anyone involved in the project. Make note of any questions or desired modifications before construction begins.
Step 2: Secure Your Property
If you have not already done so, finalize the purchase of your lot or homesite. Site conditions such as slope, soil type, easements, flood zones, and setbacks may impact construction.
Step 3: Verify Local Requirements
Every city, county, and municipality has its own building codes and permitting requirements. Contact your local building department to determine whether additional engineering, energy calculations, structural modifications, or code updates are required.
Step 4: Hire Your Construction Team
Select qualified professionals to assist with your project, including:
General Contractor
Structural Engineer (if required)
Surveyor
Civil Engineer (if required)
Interior Designer
Landscape Designer
Working with experienced professionals can help streamline the construction process and minimize costly delays.
Step 5: Apply for Building Permits
Submit your plans to the appropriate permitting authority before beginning construction. Additional documentation may be required based on your location.
Step 6: Begin Construction
Once permits have been approved, you’re ready to break ground and begin bringing your dream home to life.

House Plan Online Purchase License Agreement
Effective Date: DATE OF PURCHASE BY ONLINE CUSTOMER
By purchasing, downloading, receiving, or using any house plan, construction drawing, blueprint, or related design materials (“Plans”) from B INGENIOUS DESIGNS, LLC (“Company”), you (“Purchaser”) acknowledge that you have read, understood, and agree to be legally bound by the following terms and conditions.
Ownership of Intellectual Property
All Plans, drawings, renderings, specifications, images, floor plans, elevations, details, and related materials are the exclusive intellectual property of B Ingenious Designs and are protected by United States copyright laws, architectural copyright laws, trademark laws, and other applicable intellectual property laws.
Purchasing a Plan does not transfer ownership of any intellectual property rights.
The Purchaser receives only a limited, non-exclusive, non-transferable license to use the purchased Plans in accordance with this Agreement.
License Granted
Upon payment in full, the Purchaser is granted a limited license to use the purchased Plans solely for the construction of:
One (1) single residential dwelling
On one (1) specific property
For the Purchaser’s personal use unless otherwise agreed to in writing.
No other rights are granted.
Prohibited Uses
The Purchaser agrees not to:
Sell the Plans.
Resell the Plans.
Copy the Plans for resale.
Distribute the Plans.
Share digital files with any third party except contractors, engineers, surveyors, or permitting agencies directly involved in construction.
Upload the Plans to websites, file-sharing services, cloud libraries, or social media.
Create derivative works for resale.
Modify the Plans and claim ownership.
Remove any copyright notices or ownership information.
License or sublicense the Plans.
Reproduce the Plans for commercial purposes.
Use the Plans for multiple homes without purchasing additional licenses.
Use the Plans as templates for future projects.
Construction License
Unless otherwise stated in writing, each purchase authorizes construction of only one (1) home.
If the Purchaser intends to build additional homes from the same design, an additional license must be purchased from the Company before construction begins.
Custom Modifications
The Purchaser may make reasonable modifications necessary for construction, engineering, local code compliance, or site adaptation.
Such modifications do not transfer ownership of the Plans or create any ownership rights for the Purchaser.
The original design remains the sole intellectual property of the Company.
Copyright Protection
The Plans are protected under the United States Copyright Act, including the Architectural Works Copyright Protection Act (AWCPA).
Unauthorized copying, reproduction, distribution, modification for resale, or commercial use may constitute copyright infringement and may result in legal action.
AI Restriction: Prohibit uploading the plans to AI tools or using them to train artificial intelligence models.
No Digital Marketplace Resale: Specifically forbid listing the plans on Etsy, eBay, Facebook Marketplace, Gumroad, Creative Market, or similar platforms.
DMCA Enforcement: State that the company actively monitors for infringement and may issue takedown notices under the Digital Millennium Copyright Act.
Audit Rights: Reserve the right to investigate suspected unauthorized use or multiple-home construction.
Watermark Notice: Inform customers that digital plans may contain visible or invisible identifying information to trace unauthorized distribution.
No Assignment: Clarify that the license cannot be transferred to another person or entity without written permission.
Termination Clause: State that any violation of the agreement immediately terminates the license while preserving the company’s legal remedies.
Force Majeure: Include a standard clause addressing events beyond the company’s control, if applicable.
Digital Security
The Purchaser agrees not to:
Circumvent security measures.
Remove watermarks.
Attempt to reverse engineer protected files.
Create unauthorized digital copies.
Share download links or login credentials.
Contractor Use
The Purchaser may provide copies of the Plans only to contractors, subcontractors, engineers, surveyors, permitting authorities, lenders, or consultants directly involved in constructing the licensed residence.
These parties receive no ownership rights and may not reuse or redistribute the Plans.
Refund Policy
Due to the digital nature of architectural Plans, all sales are final.
No refunds, exchanges, or cancellations will be issued once the document has been downloaded, delivered, or otherwise made available.
No Warranty
The Company makes no warranty that the Plans will comply with local building codes, zoning requirements, homeowner association restrictions, engineering requirements, or permitting regulations.
The Purchaser is responsible for obtaining all required approvals and for hiring licensed professionals where required.
Limitation of Liability
To the fullest extent permitted by law, the Company’s total liability shall not exceed the amount paid for the purchased Plans.
The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the Plans or construction based upon them.
Indemnification
The Purchaser agrees to indemnify, defend, and hold harmless the Company, its owners, architects, designers, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
misuse of the Plans;
unauthorized modifications;
improper construction;
code violations;
construction defects; or
violations of this Agreement.
Enforcement
The Company reserves the right to pursue all legal remedies available under applicable law, including:
Injunctive relief
Monetary damages
Statutory copyright damages
Attorney’s fees where permitted by law
Recovery of investigative costs
Unauthorized use of the Plans may result in immediate termination of the license granted herein.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.
Any legal action shall be brought exclusively in the state or federal courts located in Texas.
Entire Agreement
This Agreement constitutes the entire agreement between the Purchaser and the Company concerning the purchase and use of the Plans and supersedes all prior discussions or agreements.
Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
Electronic Acceptance
By selecting the “I Agree” checkbox during checkout, placing an order, downloading the Plans, or otherwise accessing the Plans, the Purchaser acknowledges that they have read and agree to be legally bound by this Agreement.
Electronic acceptance shall have the same force and effect as a handwritten signature.
